Terms of Service

1. Services

We provide mobile and on-location barber and grooming services in South Florida, subject to availability, scheduling confirmation, weather, safe access to the service location, and our acceptance of the booking. Service descriptions and prices on the website are informational and may be updated; live prices may sync from our Square catalog.

2. Online Booking

When you book through our site, you submit a booking request with a card on file. The requested time is soft-held while we review. A booking is confirmed when we accept the appointment and any required deposit succeeds. We may decline or let a request expire if we cannot fulfill it. Cancellation and no-show rules in these Terms apply after a booking is confirmed.

3. Deposits, Card Holds & Payments

Payments are processed by Square. Depending on the service:

• Most shop services require a card on file to book — we store your card only (no hold and no charge at booking). Service is paid at completion. We may charge the card on file for no-shows under these Terms.
• House call services typically require a deposit (commonly 50%) charged when we accept your request. The remaining balance is due when service is completed unless otherwise agreed.
• Apple Pay / Google Pay may place a temporary hold when a wallet cannot save a reusable card on file.

You authorize us and Square to store your card and to process the amounts disclosed at checkout (including deposits and no-show fees under these Terms).

4. Cancellations & No-Shows

Please cancel or reschedule at least 24 hours before your appointment. Cancellations with less than 24 hours' notice, no-shows, or refusal of service due to unsafe conditions may result in forfeiture of deposits and/or charges to a card on file (or capture of an authorized hold, when a hold was used), up to the amount disclosed at booking. Rescheduling with at least 24 hours' notice is subject to availability.

5. Travel & Distance Charges

House calls within our standard service radius of our North Miami Beach base (approximately 10 miles) typically have no additional travel fee. Locations beyond that radius may incur a distance charge disclosed before or at booking. Extreme traffic, restricted access, or unsafe conditions may require rescheduling or additional fees.

6. Client Responsibilities

You agree to provide a safe, lawful location for mobile services; accurate address and access instructions; and a suitable space for grooming when a house call or mobile setup is required. We may refuse or end service if conditions are unsafe, illegal, or abusive.

7. Memberships

Membership plans are billed through Square according to the plan you select. Benefits are personal and non-transferable unless we expressly allow otherwise. Cancellation generally requires 30 days' written notice to info@cutzbymarc305.com. Unused benefits may expire per the plan terms shown at signup.

8. Website Use

You may use this website for lawful personal purposes related to our services. You may not misuse the site, attempt unauthorized access, scrape content at scale, interfere with security, or use the site to harass others. We may suspend access for abuse or security reasons.

9. Intellectual Property

Site content, branding, logos, photos, and materials are owned by us or our licensors and may not be copied or used commercially without permission.

10. Liability

We are licensed and insured for our barber services. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from use of the website or services. Our total liability for any claim related to a booking is limited to the amounts you paid us for that booking. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent allowed by law.

11. Disclaimer

The website is provided "as is." We do not warrant uninterrupted or error-free operation. Service results vary by hair type, condition, and other factors.

12. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms.

13. Changes

We may update these Terms from time to time. The "Last updated" date will change when we post revisions. Continued use of the site or services after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Miami-Dade County, Florida, unless applicable law requires otherwise.
